An additional surcharge of $100 will be incurred for any filed applications that do not meet certain requirements.

For an intent to use application, we will need to submit proof of use later in the process. We would only file an intent to use application and the below fees would only apply if you are not using the trademark in the US in relation to the relevant goods and/or services at the time of filing. The fees for submitting proof of use in due course are as follows:

Notes: The provisional application is essentially a placeholder. It gives you a filing date (“patent pending”) but it is never examined and in order to proceed with obtaining an issued patent you will have to file a non-provisional within 12 months from filing the provisional.

It takes us approximately 6 – 8 weeks to prepare and file an application. Nonprovisional applications are typically examined 18 to 24 months from the date of filing.

Once an application is examined we will enter the prosecution stage of the patent process. During the prosecution stage, the examiner issues certain objections and rejections. These objections and rejections may be based on minor issues in the application or based on prior-filed patent applications and patents which disclose similar inventions (referred to as prior art). In response to these objections and rejections, we can amend the application and/or submit arguments in an attempt to resolve the issues with the application and obtain a granted patent. On average two or three refusals are received. We offer flat fees for responding to refusals. These fees range from $500 to $4,500 per response and are on the higher end where a lot of prior art is cited. Once the patent is granted there is an issue fee which ranges from $600 to $1,000 depending on whether you are a small entity or a micro-entity.

Utility applications are typically granted approximately 2 to 3 years from filing. However, you will have “Patent Pending” as of the date of filing.
